Judge Dismisses Industry Lawsuit

A federal judge has dismissed TYR’s anti-trust civil lawsuit against Speedo, USA Swimming and Mark Schubert, USA Swimming’s head coach and national team general manager.

The suit alleged that these entities intentionally disparaged products of Speedo competitors. Judge James V. Selna approved a motion for a summary judgment in favor of the defendants and denied TYR’s motion for reconsideration. The ruling stated, in part, that TYR had not provided enough evidence for a jury to infer “a significant and enduring adverse impact on competition.” TYR released a statement disagreeing with the court’s conclusion.
