A near-drowning victim who has sustained permanent brain damage will receive $7 million from Erie County, New York. The settlement is reportedly one of the largest of its kind in the county’s recent history; however, it’s not yet clear who will pay, according to local media. In 2009, Jannette Morales was pulled out of Buffalo’s Rees Street pool by her son, when he found her floating. The pool was crowded and the personal injury suit filed on Morales’ behalf claims lifeguards were inattentive and not properly trained and supervised. At the time, the city of Buffalo owned the pool, but the county operated it.
