AquaStar Pool Products of San Diego filed a lawsuit last month accusing Hayward Industries of engaging in anticompetitive practices.
Hayward has repudiated the allegations, but a motion to dismiss the case was denied and the litigation is now moving into discovery.
The complaint was filed in the District Court for the Central District of California. It states that Hayward threatened to withhold selling to distributors who offered AquaStar pool products and reserved discounts and other incentives for those that agreed not to purchase or distribute the AquaStar products.
