Last month, 14 charges were dropped against the Limoges, Ontario, Canada-based Calypso Theme Waterpark, with only six of 20 safety citations sticking in court.
Now, another lawsuit against the facility has been dropped after a judge found that a woman who broke her elbow at the facility could not prove Calypso was negligent.
Danielle Yelle was seeking $825,000 in damages after she reportedly slipped and fell on July 11, 2010, upon entering the Jungle Run river ride, according to the Ottawa Citizen.
Ontario Superior Court Justice Robert Beaudoin dismissed the lawsuit after concluding that Calypso took reasonable care to see that park users were reasonably safe while in the park, according to the news agency. He ruled that Yelle had not slipped as a result of any negligent act or omission by Calypso.
